IKEJA, Lagos – A special offences court sitting in Ikeja has fixed June 9 to rule on whether to commence trial of an agronomist, Omolara Sevensson, her company, OOK and Eilvor Group Ltd, who allegedly obtained N16.3 million from Mr Peter Emeya, the Managing Director and CEO of Peter Groups Services on the pretext of selling to him five 40ft containers of charcoal.
Omolara Sevensson and her company OOK and Eilvor Group Ltd were arraigned by the Economic and Financial Crimes Commission, EFCC on 6-count charge of obtaining money under false pretences contrary to Sections 1(1)(a) and (1)(3) of the Advance Free Fraud and other Related Offences Act of 2006.
Counsel to the defendant, Adebisi Orija had prayed the court to dismiss the charge, arguing that there was a subsisting court judgment relating to the case. Mr. Orija argued that the defence had listed five grounds to support the motion and filed a written address dated Dec. 6, 2021, which he sought to adopt.
“Our argument basically is that the fact upon which the charge was filed against the defendant has been subjected to a subsisting judgment delivered by Justice Folarin.
“The defendant filed a motion seeking release of her passport, which is part of the judgment delivered by Justice Folarin, but as at today, EFCC has not obliged. The defence counsel urged the court to dismiss the charge as he described it as an abuse of court procedure.
In a counter response, EFCC counsel, Mr Ayanfe Ogunsina, told the court that prosecution had filed a counter-affidavit.
Mr Ogunsina informed the court that the charge had earlier been filed before Justice Sherifat Sholebo, since 2019 but was struck out because the defendant absconded. He urged the court to consider the nature of the offences such that the defendant fraudulently obtained money from the petitioner.
“I pray the court to proceed with trial in the interest of justice,” Ogunsina said. After entertaining submission of counsels, Justice Oluwatoyin Taiwo five June 9, 2022 to rule on the matter.
