MOSCOW, Russia – Ministry of Justice of Russia has drafted a federal law to amend Articles 29 and 435 of the Criminal Procedure Code of the Russian Federation” on Psychiatric Care and Guarantee of the Rights of Citizens.

The draft laws were prepared in order to implement the Decree of the Constitutional Court of the Russian Federation of May 24, 2018 No. 20-P, which noted the expediency of specifying the mechanism and conditions for placing the suspect, the accused, to whom detention was applied as a preventive measure, psychiatric care in a hospital setting.

It is proposed to clarify the special powers of the court to decide on the temporary placement of a suspect, accused, detained in a medical organization that provides psychiatric care, and on the extension of his stay in this organization. The law determines the procedure and grounds for the extension of the period of such stay.

In addition, a mechanism is defined for informing the medical organization of the preliminary investigation and court of the improvement of the said person’s status in order to allow the court to decide whether to terminate his stay in the medical organization and apply an appropriate preventive measure to it.

Corresponding changes, providing the grounds for placing a person in a medical organization, the procedure for his examination, rights, as well as the mechanism for informing the medical organization of the preliminary investigation and the court of improving his condition, are proposed to be introduced into the Law of the Russian Federation “On Psychiatric Care and Guarantees of the Rights of Citizens “.
