IBADAN, Nigeria – In a major legal development, the Court of Appeal sitting in Ibadan has cleared the path for the 2026 Nigerian Bar Association (NBA) National Officers’ Election. On July 14, 2026,
the appellate court set aside the proceedings and interim ex parte orders of the Oyo State High Court, which had temporarily halted the activities of the Electoral Committee of the Nigerian Bar Association (ECNBA).
The unanimous judgment, delivered by a three-man panel, resolves a high-stakes legal dispute that threatened to derail the governance transition of Nigeria’s largest professional body of legal practitioners.
The legal battle stemmed from a ruling issued on March 4, 2026, by Justice G.A. Opayinka of the Oyo State High Court. That lower court order had granted an interim injunction restraining members of the ECNBA from taking further steps toward organizing the national election.
The plaintiffs in the lower court suit—which included Chief Gabriel Ojo Adekunle Ijalana and others—had challenged the composition of the ECNBA and sought specific interpretations of the 2025 amended NBA Constitution alongside provisions of the Legal Practitioners Act.
Parallel disputes also emerged out of the Oyo State High Court (specifically Suit No. I/205/2026) regarding the regional zoning of the NBA Presidency.
Members of the regional Egbe Amofin O’odua (the Yoruba lawyers’ association) had sought an injunction to compel the NBA to recognize only their designated consensus candidate for the Western Zone.
Why the Appeal Court Overturned the Halt
In the lead judgment delivered by Justice Fadawu Umaru—with Justices Kenneth Ikechukwu Amadi and Fatima Binta Zubairu concurring—the Court of Appeal ruled that the Oyo State High Court completely lacked the jurisdiction to entertain the matter.
Justice Umaru emphasized the constitutional weight of jurisdiction, declaring:
”Jurisdiction remains the lifeblood of every judicial proceeding. It is elementary that where a Court lacks jurisdiction, the entire proceedings, no matter how well conducted, are a nullity.”
The appellate court held that the Oyo State High Court lacked personal, territorial, and subject-matter jurisdiction to issue directives halting the national ECNBA operations.
Additionally, the court heavily criticized the practice of “forum shopping”—where litigants seek out specific courts favorable to their claims rather than approaching the correct territorial jurisdiction—and subsequently struck out the original suit entirely.
The ruling also clarified vital boundaries between the judiciary and regulatory bodies, emphasizing that external legal officers,
including the Attorney-General of the Federation (AGF), cannot issue administrative directives to override court jurisdiction or established constitutional processes within professional associations.
When is the 2026 NBA Election Holding?
With all legal hurdles effectively dismantled by the Court of Appeal, the ECNBA is fully authorized to proceed with the elections.
According to the revised timetable officially released by ECNBA Chairman Aham Ejelam, SAN, and Secretary Ibrahim Aliyu Nassarawa, Esq., the 2026 NBA National Officers’ Election will hold on Saturday, July 18, 2026.
The ECNBA adjusted the election date from its originally scheduled weekday of Monday, July 20, 2026, to a weekend slot to accommodate wider participation by eligible lawyers across the country.

Voting Window: Electronic voting polls open at 12:00 a.m. WAT and close at 11:59 p.m. WAT on Saturday, July 18, 2026.
Voting Method: Fully electronic. Eligible voters must complete a secure verification process using their Supreme Court Number (SCN) and a One-Time Password (OTP) on the ECNBA voting portal.
Collation and Declaration: Collation and audit verification will happen immediately after the polls close, with official results scheduled to be declared on Sunday, July 19, 2026.
Post-Election Petitions: Any disputes or petitions regarding the election outcome must be filed by July 25, 2026, and will be resolved by the Appeals Committee on or before August 16, 2026.
