ABUJA, Nigeria – The Appeal Court sitting in Abuja today restored Senator Ademola Adeleke as governor of Osun State. Recall that his election was invalidated by the Election Tribunal sitting in Osun on the ground of alleged overvoting and declared the former governor as winner.
The tribunal also ordered INEC to withdraw the certificate of return issued to Adeleke and issue a fresh one to Oyetola as the duly elected governor of Osun.
But the Appeal Court sitting in Abuja today vacated the judgement. In a unanimous decision, the three member panel held that the Osun election tribunal erred in its judgement.
Justice Mohammed Lawal who read the lead judgment awarded N500, 000 cost against the All Progressive Congress, APC, and its candidate, Gboyega Oyetola.
