Mohbad: Naira Marley, Sam Larry, tackles police, magistrate over prolonged detention

LAGOS, Nigeria – Embattled Nigerian musician Abdulazeez Fashola better known as  Naira Marley and his music promoter, Samson Eletu, alias Sam Larry have decided to fight the Nigerian Police Force for their prolonged detention over the death of Ilerioluwa Promise Aloba, better known as Mohbad.

 

They did this by filing a fundamental rights suit to contest their prolonged detention in connection with the death of 27-year-old Mohbad.

 

The lawsuit, brought before the Federal High Court in Lagos, names the police and Lagos Magistrate Adeola Olatunbosun, who ordered their 21-day remand in police custody, as defendants pending further investigation in the matter.

 

The suspects and others have been in detention even after the Police briefed the press as per the possible death of Mohbad, attributing the death to a nurse. Besides, the Nigeria Police is yet to inform the public about the result of autopsy on Mohbad more than one month after Mohbad’s corpse was exhumed for examination.

 

Both Naira Marley and Sam Larry are each seeking N20 million in damages from the defendants.

 

Their lawyer, Mr. Olalekan Ojo (SAN), filed the suit, urging the court to declare that their continued detention at the Homicide Section of the Lagos State Police Command in Panti, Yaba, since October 4, 2023, constitutes a violation of their rights.

 

The deponents in the attached affidavits to their suits detailed how their troubles began when they were arrested by the police on October 3 and 4, 2023, on allegations of being connected to the death of Ilerioluwa Aloba, also known as Mohbad.

 

“On the 4th day of October 2023, the Commissioner of Police sought an order in the Magistrates’ Court, held at Yaba, to remand them for 30 days. Chief Magistrate Adeola Olatunbosun granted the police application to remand them for only 21 days in police custody,” the affidavits stated.

 

It’s worth noting that the 21-day remand order granted by Chief Magistrate Olatunbosun expired on October 26, 2023, and has not been renewed.
