IKEJA, Lagos – Lawyers and clients present in court were today astonished when a sex tape involving an ex-banker and a lady was played at an Ikeja High Court. The tape was the sexual encounter between Mr. Peter Omokaro, married with three children and one Miss Titilayo Nosa-Igiebor, his lover. Omokaro, an ex-banker in his early sixties had draged Nosa-Igiebor, a 33-year-old businesswoman to court for refusing to pay N15 million loan given to her during the course of an amorous relationship.
In her testimony , Miss Nosa-Igiebor, daughter of Editor-in-Chief of Tell Magazine, said there was no loan but simply sex for N15 million. According to her, Omokaro never gave her the promised N15 million “friendly loan”. The businesswoman via her defence counsel Mr Victor Okpara claimed that Omokaro became vindictive after the their relationship turned sour and is seeking to punish Nosa-Igiebor by taking her to court after their relationship ended.
Okpara in proving that the money was given as a gift played excerpts of over an hour long tape which showed Omokaro and Nosa-Igiebor lying in bed in a hotel room agreeing to the terms of the loan before engaging in sexual intercourse. Omokaro before signing the agreement could be overheard saying that “I hope I am not signing my death warrant”, he was also overheard telling Nosa-Igiebor that he had no intention of getting the funds back.
Okpara tendered a copy of the loan agreement to the court as evidence noting that Clause Five of the agreement exempted Nosa-Igiebor from repaying the alleged loan because of their sexual relationship.
Clause Five of the agreement which pertains to Waiver of Rights states “Peter forever waives all rights to loan payback forfeiting totally loan given if Titilayo agrees to and has sexual intercourse (SEX) with Peter. While being cross-examined by Mr. Jerry Omoregbe, counsel to Omokaro, she said apart from being lovers she also had a business relationship with the ex-banker through her company Tilimanjaro Nigeria Ltd and Nichole Integrated Ltd (Omokaro’s company).
“Tilimanjaro was my first company, I had no prior experience and I was still setting up at the time, I went to meet Peter my boyfriend at the time in assisting me in giving my brother Ahmed money for aviation school.
“Peter my boyfriend said he will give me the money as a gift and that we should draft out an agreement so that my brother can see that is serious and take his schooling seriously. He invited me to the hotel as shown in the video and he agreed that I should make the agreement and I drafted the agreement in my letter headed paper, the agreement was between Peter Imafidon Omokaro and Titilayo Nosa-Igiebor.
“The friendly loan was never given to me, that agreement was signed on May 15, 2011 which was a Tuesday, he said he will pay the money into my brother’s account on Thursday but he never did,” she said.
After their relationship turned sour in 2011, Omokaro had accused Nosa-Igiebor of stealing Toyota Venza 2010 model with registration number CT370FKJ valued at N2 million as well as N106million.
She had earlier been arraigned at an Igbosere Magistrates’ Court in April 2012 and remanded at Kirikiri Prisons following her failure to meet her bail conditions. Following her arraignment, the former lovers, agreed to settle their dispute out of court with Nosa-Igiebor returning the car and property given to her by Omokaro during the course of their relationship.
However, Omokaro instituted a civil suit against Nosa-Igiebor at the Ikeja High Court following her failure to refund the alleged “N15million friendly loan”. Justice Raliatu Adebiyi adjourned the case until Feb. 20, 2019 for adoption of final written addresses.
