IKEJA, Lagos, Nigeria – A consultant physician at the Mirabel Medical Centre, Dr. Olayioye Oluwatoyin on Friday told a Sexual Offences Court sitting in Ikeja, Lagos that her findings on 2-and-half year old girl defiled by a supervisor with Chrisland School, Mr. Adenekan Adegboyega revealed penile penetration of the virgina.




The consultant, also a staff at the Lagos State University Teaching hospital said she carried out medical examination on the victim following referral from Area F on 24th November, 2016.

“Her blood level was okay, she was not in distress and she was well hydrated.
She explained further that on examining the child from head-to-toe. There was no fresh findings of sperm related to the case. My Lord, in my systematic examination, on the genital area (vagina) there was white patches, urethra opening, there was anula hymen with notches at 3 ‘o’ clock and 9 ‘o’ clock.

“My Lord, there was generalise and redness on the vulva and pain when touched.”
While being led in evidence by State Counsel Mr. Babajide Boye, to explain in simple terms what she meant by systematic examination, the fifth prosecution witness enumerated, “The Systematic examination involved the genital area which is the vagina. On examining the client, the client was placed in modified position. That is, the patient will lie on her back and the two legs will be placed in frog-like position.

She told Justice Sybil Nwaka that after exposing the client she found that the genital area was not in teddy state.

“My lord as I’ve said where the urine comes from there were whitish patches which were not to be there. There was scaly skin folds around there, which could be due to assault to the area. My Lord, we further examined the vagina, there was redness which was not to be”, she explained.

Speaking on touch to the area, she said there was pain and that on parting the vagina lips, we found an anula hymen and that she noticed healed lacerations, a situation she described could occur as result of blunt penetration injury.

She added that blunt penetration could be due to penile injury, finger and any other blunt objects. She also said that the child told her that the perpetrator put the ‘wee wee’ in her ‘wee wee’ and her mouth and also told her not to tell her mother or else she would die.

“My Lord, as a medical expert, we make use of history, findings etc, the conclusion in this client, we make use of the client’s verbal declaration, mother’s verbal declaration, systematic examination and genital findings.

“So I made the conclusion based on the patient, mother, which was coherent with my findings that it could be due to penile penetration”, she asserted.

During cross examination by Counsel to Adegboyega, Mr. Olatunde Adejuyigbe contended with the witness that she was not a consultant because of her claim that she was a trained consultant and forensic expert. Posing some questions to her, Adejuyigbe asked, You are not a consultant?

Defence: Do you have a certificate in Forensic expert?
Prosecution Witness: I am a trained Forensic Expert.

Defence: When was your certificate issued?

Prosecution witness: In 2013.

Defence: Who issued it?

Witness: It was issued after a training programme organises by Miniatry of Justice in collaboration with Mirabel center and LASUTH, Ikeja.

Explaining further, she said someone from a UK based St. Mary Hospital was the trainer and she could not remember his name in particular. When the defence counsel took her up on who led the medical investigation team, she said she was the leader of the team and personally conducted the examination.

She was asked about the accuracy of the information she gave, when asked if it is tied to the occurrence. The doctor explained: “The findings will depend on the individual and expertise of the doctor.”

The defendant counsel further asked her, did you asked the mother whether the child has seen a doctor before being brought to her, she quickly replied, “I can’t remember. The defence counsel thereafter tendered a medical report by Mirabel Centre and the judge admitted it as evidence. The matter involving the supervisor with Chrisland School, Mr. Adenekan Adegboyega and the two year old girl has been adjourned till July 4 for further hearing.
