IKEJA, Lagos, Nigeria – Justice finally came the way of late Human Right Lawyer, Mr. Kunle Fadipe, two years after he was killed. His killer, Mr. Oluwaseun Oladapo was today sentensed to death by hanging by Justice Oluwatoyin Ipaye.

While delivering judgment, Ipaye held that the convict stabbed the deceased to death at his home in Harmony Estate, Ifako Ijaiye, within the State on July 3,2014.

It will be recalled that the convict was arraigned on five count charge bordering on murder, armed-robbery and assault. Director of Public Prosecution, Mrs Idowu Alakija , had called on five witnesses to prove the case before the court.

Justice Ipaye who solely relied on the evidence given by a pathologist at the Lagos State Teaching Hospital (LASUTH), Mr. Sunday Soyemi, who carried out post-mortem examination on the deceased held that the deceased had passed out due to excessive blood loss, as his jugular vein was almost severed, adding that the deceased had pallet wounds, abrasion, lacerations on the jugular vein.

The pathologist added that there was bruise on the deceased head, the stomach was deeply cut in two inches and the skin covering the skull was open, emphasised that the convict stabbed the deceased at the abdomen.

However, the judge said “I hereby find the defendant guilty of all the counts, as the prosecution has proved beyond reasonable doubt its case against the defendant.”

“The knife with which the murder was carried out is one of the most vicious and dangerous looking knives I have ever seen. Tthe defendant came with a calculated intention to rob the occupants of their valuables. I hereby pronounce the defendant death by hanging until death. ”

Moreover, the defence counsel, Mr. Worter Oduagbaka, pleaded for the court to temper justice with mercy. The convict is asking for mercy, he’s a first-time offender, we’re asking this honourable court to give him a second chance. He is still a young man that can still help the society ”

In a swift response, the prosecution counsel, Mrs. O.A Oyindasa stated that the deceased was not giving a second chance with his family and she further urged the court to pronounce it’s judgment. The deceased was not giving a second chance, his children were not given a second chance to see their father, we pray this court to impose the mandatory sentencing my lord.”
