Nigeria, Lagos, June 28, 2016 – Justice Lawal Akapo of an Ikeja High Court today admitted in evidence video recordings of the aircraft that hovered around the Synagogue Church of All Nations(SCOAN) before the building carved in, killing all 116 people, mainly South Africans seeking miracles in Nigeria.
The video was played after a ruling by Justice Akapo who dismissed all grounds of objections raised by defence council led by the two Senior Advocates (SANs), Chief Efe Akpofure, Titilola Akinlawon and another lawyer Mr. Olamilekan Ojo Esq, representing Trustees of Synagogue.
“I find no merit in the objections, they are overruled, the video clip and accompanying documents are admitted in evidence, he said.” Justice Lawal-Akapo said the prerogative of a court in admitting a document into evidence was its relevance.
“For a document to be tendered in evidence, the guiding principle is relevance and not custody, the questions to be asked is whether the document is needed and admissible in law the judge ruled,” adding that it is not true that only the maker or producer that can tender the video clip in evidence.
During the cross-examination of the former Commissioner for Physical Planning and Urban Development, Mr. Olutoyin Adedamola Ayinde told the court that he visited the site of the collapsed building twice.
Justice Lawal-Akapo, adjourned the case to 10, 11 and 12 October, 2016, for continuation of trial.
