Nigeria, March 12, 2016 – A Court of Appeal sitting in Lagos today affirmed the five year jail term passed on President of Actors Guild of Nigeria (AGN), Mrs. Ibinabo Fiberesima.
She had through her counsel, Nnaemeka Amaechina filed an appeal against the judgment of a Lagos High Court which sentenced her to five year jail term for causing the death of one Giwa Saraj.
Justice Deborah Oluwayemi had sentenced her to five year jail for reckless driving and in the process causing the death of Suraj in an auto accident along the Lekki-Epe Expressway, Lagos.
But Fiberesima had through her counsel urged the court to set aside the sentence and restore the decision of the Magistrate Court which sentenced her to a fine of N100, 000 on conviction for the death of Saraj.
Delivering his judgment Friday, the appellate court dismissed the appeal and affirmed the High Court’s judgment, in a unanimous judgment read by Justice Jamilu Yammama Tukur.
The court held that the trial Magistrate Court lacked the discretion to grant Ibinabo an option of fine after her conviction, stressing that her appeal lacked merit and thereby dismissed it accordingly.
