Tambuwal Has Lost His Seat for Defecting from PDP to APC – Clerk

December 2, 2014 – Elder Statesman, Chief Edwin Clerk has said that the embattled Speaker of the House of Representatives, Alhaji Aminu Tambuwal has lost his seat in the House having defected from the Peoples Democratic Party(PDP) to the All Progressive Congress(APC).

Clerk who spoke in Abuja said his observation is based on section 109(g)of the 1999 Constitutions which states that a “member of the House of Assembly shall vacate his seat if he being a person whose election to the House of Assembly was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which the House was elected, provided that his membership of the later party is not as a result of a division of the political party of which he has previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored”.

He said that he is surprised that the Minister of Justice and Attorney General of the Federation, Mr. Mohamed Bello Adoke has not written to the Speaker to step down in a bid to protect the Nigerian constitution the way he has written other governors.

He said that it remains the duty of the minister to protect the Nigerian constitution and that the speaker ought to have stepped down as an honourable member of the house.
