LAGOS, Nigeria – Mrs. Adediwura Adebukola Babalola has obtained an injunction restraining her husband, Dr. Rotimi Babalola, who is the Chief Medical Director of Chevron Nigeria Ltd, Chevron CMD, from evicting her from her matrimonial home.
Justice Olukayode Ogunjobi who gave the order in the suit marked LD/9231WD/2021, specifically barred the Chevron CMD, his servants, privies or workmen from entering, trespassing or otherwise disturbing occupants of the building situated at No. 8 Service Crescent, Cooperative Villa, Badore, Ajah, Lagos, pending hearing and determination of the motion on notice filed in the divorce petition by his wife.
Justice Ogunjobi granted the order after hearing arguments canvassed by Adeleke Agbola, counsel to the petitioner who pleaded for accelerated hearing of the motion on notice following alleged desperation of the Chevron CMD to evict his wife from her matrimonial home.
The case will be heard September 20 when judges in Lagos State would have been back from their annual vacation.
According to the petition before the court the respondent (Mr. Babalola) abandoned the matrimonial home since January 1st 2021, leaving the petitioner and the only child in the matrimonial home.
“The respondent has been adamant in his resistance to efforts to reconcile the two parties by their Counsel, A.O Agbola, Esq of Cheakley Chambers and Olusola Idowu (SAN) of Olusola Idowu & Co. for petitioner and Respondent respectively.
“The petitioner contended that the divorce petition became the last option for her when it was apparent that the Respondent was not ready for any peaceful reconciliation coupled with his alleged constant harassment, intimidation, and threat of unlawful forceful eviction from her matrimonial home”.
She also alleged physical by the Chevron CMD.
