IKEJA, Lagos – Lawyer representing, notorious kidnapper, Chukwumeme Onwuamadike, Mr. Ogungbeje today told the court that the name of the first defendant was not contained in the proof of evidence before the court and that there was therefore no reason to hit the ground running with the trial.
Citing Okaegbe vs state, he argued that once a charge is amended, everything in the initial charges is totally wiped off including the proof of evidence. He also quoted FG VS Bola Ahmed Tinubu to support his claim.
He urged the court to quash the charges. Ogungbeje made the remarks, while appearing before Justice Hakeem Oshodi of an Ikeja High Court in a case involving the State of Lagos VS Chukwumeme Onwuamadike and five others.
In reply, the Prosecution led by C.K Shitabey said the authority cited are relevant only in civil cases. Details later.
