March 24, 2015 – A Federal High Court sitting in Lagos today ordered the Nigerian Communications Commission(NCC) to pay the All Progressive Congress(APC), the sum of N500 million for shutting down SMS platforms intended to be used to raise campaign funds for the General Muhammadu Buhari and Professor Yemi Osinbajo(GMB/PYO) Campaign Organisation.
The APC had joined in the N25 billion suit, NCC, Etisalat, Airtel and Globacom.
But Justice Ibrahim Buba declared that APC was protected by the constitution to push for the enforcement of its fundamental right once violated, thereafter threw out NCC’s counter-affidavit and ruled that the action of respondents were illegal and unconstitutional.
The damages were going to be pay jointly and severally by all the respondents the Judge asserted.
Director General of GMB/PYO Campaign organisation, Mr. Babatunde Fashola who is also the governor of Lagos State had expressed misgiving when the NCC shot down the platform few minutes after it was launched in Lagos.
The platform was to enable Nigerians to donate N100 to the campaign organisation.
