ABUJA, Nigeria – It is certainly a bad day for Nollywood teenage sensation, Regina Daniels, whose husband, Prince Ned Nwoko has been sacked by the Appeal Court sitting in Abuja.
Peter Nwaoboshi and Prince Ned Nwoko contested for Senate Position to represent Peoples Democratic Party(PDP) in Delta North Federal Constituency during PDP primaries. PDP won during the 2019 election, with both candidate laying claim to the seat.
But Senator Ned Nwoko filed an appeal at Federal High Court, Abuja challenging elegability of Peter Nwaoboshi to represent Delta North Senatorial District. In April, a Federal High Court in Abuja ruled in favour of Prince Ned Nwoko.
Justice Ahmed Mohammed then held that Nwaoboshi, a serving senator, was not the duly elected candidate of the PDP in the primary election and ordered the Independent National Electoral Commission(INEC) to withdrew the Certificate of Return issued to Peter Nwaoboshi and issue another to Prince Ned Nwoko.
But the Court of Appeal today reversed the judgement, ruling that Peter Nwaoboshi is the true representative of the PDP.
Ruling on the matter, the appellate court ruled that the matter ought to have been brought before the lower court before the expiration of 14 days from the time of the incidence that birthed the suit.
It further ruled that the failure of the applicant at the lower court to file the case before the expiration of 14 days meant that the case had become statute barred and the lower court lacked jurisdiction to entertain the matter in the first place.
“As at the time the matter was instituted at the Federal High Court, the case was statute barred. We set aside the decision of the Federal High Court and strike out the case,” the court ruled.
