Abuja, Oct 5, 2016 – The Code of Conduct Tribunal sitting in Abuja today struck out motion by President of the Senate, Dr. Bukola Saraki seeking to disqualify Chairman of the tribunal, Justice Danladi Umar.
SARAKI LOSES BID TO DISQUALIFY CCT CHAIR, JUSTICE DANLADI UMAR
Saraki had accused Umar of bias and requested the CCT chairman to disqualify himself from hearing his case of non-declaration of asset.
During the trial today, his lawyer, Paul Erukoro insisted that Saraki was not confident of a fair trial in the CCT.
Ruling on the motion, Chairman of the Tribunal said as human beings, individuals are bound to make mistakes and that it is only (the) Almighty God that is infallible, adding that he is constrained by the provisions of the Code of Conduct Act and can therefore not disqualify himself.
He said he can only be removed on the ground of age in terms of retirement and that only President Muhammadu Buhari could remove him but that he will have to send an address to the National Assembly and that without the address, there is nothing the National Assembly could do.
He, therefore, threw out the application for lack of merit.
