IKEJA, Lagos – Embattled Speaker of the Lagos State House of Assembly, Hon Mudasiru Obasa has continued his battle in court even after he was allegedly reinstated by five loyal lawmakers.
At the resumption of sitting today before Justice Yetunde Pinhero,
Obasa denied being out of Nigeria when notice for his removal was served on members of the Lagos House of Assembly.
Counsel to Obasa, Afolabi Fasanu, SAN, in response to the 1st defendant’s counter affidavit in opposition of the amended originating summons, said he was around and available in Lagos between January 8 & 10, 2025.
It further states that there was no sitting on January 13, 2025, in accordance with the constitution and the standing rules of house of assembly, adding that notice of the meeting was backdated to cover up the alleged unlawful convening and sitting of the house.
He further averred that the purported plenary of January 13, 2025, was not properly convened as envisaged pursuant to Section 92 of the Constitution of Federal Republic of Nigeria, 1999.
In response, Counsel representing the House of assembly, Femi Falana (SAN) requested Justice Yetunde Pinhero for more time to file a response to a court process filed by the speaker’s counsel, Afolabi Fashanu (SAN).
The lead counsel representing the deputy speaker, Mojisola Meranda, Tayo Oyetibo (SAN) also informed the court that he needs time to file a response to Mr Obama’s claims, as they contained weighty allegations of fraud.
Justice Yetunde Pinheiro has adjourned to Monday, March 17 in the interest of justice in the matter, for hearing of all applications including the substantive action.
