CAS upholds Club Alianza Lima appeal, deducts points from AFC

LAUSANNE, Switzerland – The Court of Arbitration for Sport (CAS) has upheld the appeal filed by Club Alianza Lima against the decision n° 0003-TCL-2021 rendered by the Tribunal de Concesión de Licencias of the Peruvian Football Federation (FPF, acronym in Spanish) on 27 January 2021 .
In the Challenged Decision, the Tribunal de Concesión de Licencias of the FPF (2nd instance) decided that in accordance with the Reglamento para la Concesión de Licencias de Clubes de Fútbol Profesional of the FPF (“RL”), Club Alianza Lima was found to have no standing to appeal the decision rendered by the Comisión de Concesión de Licencias of the FPF (1st instance) in which Asociación Fútbol Club Carlos Stein was sanctioned with a fine for breaching the RL.
During the hearing held by video-conference on 15 March 2021, the Parties, the witness and experts were heard by CAS. The CAS Panel in charge of this matter established that, in accordance with the applicable rules, Club Alianza Lima did have standing to appeal the decision in which the Asociación Fútbol Club Carlos Stein was sanctioned by the Comisión de Concesión de Licencias of the FPF.
Additionally, the CAS Panel determined that the sanction imposed by the Comisión de Concesión de Licencias of the FPF to the Asociación Fútbol Club Carlos Stein was not consistent with the RL. Consequently, the Panel set aside the Appealed Decision and replaced it by a new one, by which the Asociación Fútbol Club Carlos Stein is sanctioned with a deduction of two (2) points in the table of the Peruvian Liga 1 for the season 2020.
