IKEJA, Lagos – It was moment of victory for the Oba of Lagos, Oba Rilwan Akiolu II, when a Lagos High Court sitting in Ikeja, ruled that his kingship is legitimate, lawful and valid.
The court presided over by Justice Babajide Candide Johnson ruled that the claimant failed to prove their case and that what they tendered as evidence was incohate, full of inconsistence, adding that the burden of proof lies on he who alleges but that the evidence put before the court by the defence team is superior and that the defence has been able to prove their case beyond resonable doubt.
I hereby hold that the baship of Oba Rilwan Akiolu of Lagos is legitimate, lawful and valid. He averred that documentary evidience helps to show where the truth lies.
He had ealier on ruled that the the court lacked the juridiction to upturn long established custom of over 200 years for entroning the Oba of Lagos and that what the claimant had attempted to do with the suit is a burning desire to overtun succession disaster of over 239 years. According to him, the ruling house of Ologbokutere have produced the Oba of Lagos in the past 223 years.
He avered that where a statute has giving jurisidiction to tribunal, the high court shall only assume a supervisory role.
Adding that to do otherwise will be a recipe for disaster for governance of Lagos state.
