Lagos Appeals Court Ruling for Movement on Environmental Sanitation

[wysija_form id=”1″]March 17, 2015 – The Lagos State has said that it will appeal decision of a Federal High Court which nullified restriction of movement on the monthly environmental sanitation days.

Justice Mohammed Idris of the Federal High Court, Lagos had nullified restriction of movement after relying on arguments advanced by counsel to the Lagos State Government, Mr. Jonathan Ogunsanya, who cited section 39 of Lagos State Environmental Sanitation Law, 2000 and Ebun-Olu Adegboruwa who had argued that there was no law in Lagos state authorizing restriction of movement on environmental sanitation days but an executive order.

Idris ruled that the Constitution of the Federal Republic of Nigeria grants freedom of movement to every citizen and such freedom cannot be taken away by executive proclamation, in the absence of any law to that effect.

Speaking on the judgement, Commissioner for Justice, Ade Ipaye said the judgment was unjust and that the government would immediate challenges it at the Appeal Court.

“We are of course not satisfied with that decision of the Federal High Court looking at the density of Lagos being the highest in Nigeria,” he said.

He said the sanitation exercise had made Lagos the toast and pride of the nation with many states coming to understudy how Lagos is achieving success in the sanitation exercise.

“This exercise and our sanitation programme in general have made Lagos the envy of other states, many of whom have sent their officials to understudy it. We strongly believe that it is a necessary rule in a society such as ours. We are therefore filing an appeal immediately,” Ipaye said.

The policy of the Lagos State Government restricts citizens to their homes for three hours between 7am and 10am every last Saturday of the month.
